Public-Facing Terms for All Visitors

These Public Website Terms of Use (“Public Terms”) govern your access to and use of the Mendry, Inc. website(s), pages, directories, forms, educational content, and related online services (collectively, the “Site”) operated by Mendry, Inc. (“Mendry,” “we,” “us,” “our”).

Age Notice (21+): The Site contains cannabis-related educational content and is intended for adults 21 years of age or older.

By accessing or using the Site, you agree to these Public Terms. If you do not agree, do not use the Site.

1) Who We Are

Mendry is a Florida nonprofit corporation recognized as an IRS 501(c)(3) public charity.

Mendry is independent and is not part of, affiliated with, or endorsed by the U.S. Department of Veterans Affairs (“VA”) or any government agency.

2) Age Restriction (Cannabis-Related Content)

The Site contains information about medical cannabis and cannabis-related topics and is intended for adults.

You must be at least twenty-one (21) years old to access or use the Site. By using the Site, you represent and warrant that you are 21 or older.

We do not knowingly allow use of the Site by anyone under 21. If we learn that a person under 21 has provided personal information to us, we may delete that information and restrict access.

3) What the Site Is (and Is Not)

A) Education and information only

The Site provides general educational and informational content. Nothing on the Site is medical advice, legal advice, billing advice, credentialing advice, financial advice, or a substitute for professional judgment. If you need medical or legal advice, consult a qualified professional.

B) No medical services; no prescriptions; no sales

Mendry does not provide medical treatment, diagnose conditions, prescribe medications, or issue medical cannabis certifications/recommendations. Mendry does not sell cannabis and does not facilitate cannabis purchases.

C) Directory platform only; no endorsement

The Site may include directories or listings of third parties (for example, providers, clinics, enrollment coordinators, sponsors, or other resources). We do not endorse, recommend, certify, warrant, or guarantee any third-party product, service, or outcome.

D) No guarantee of outcomes

Nothing on the Site—including any directory listing, badge, education content, screening indicator, or “verified” indicator—is a guarantee of:

  • eligibility for VA Community Care,
  • VA authorization of care,
  • acceptance into any network,
  • reimbursement or payment timelines,
  • appointment availability, quality, or outcomes.

Decisions about eligibility, authorization, participation, and payment are made by third parties under their own rules and processes.

4) Federal/State Law Notice

Cannabis remains illegal under federal law and is regulated differently by state and local laws. You are responsible for understanding and complying with all applicable laws in your jurisdiction. The Site is provided for educational purposes only and does not provide legal advice.

5) Your Responsibilities as a Visitor

You are responsible for:

  • independently verifying any third party’s credentials, availability, and suitability;
  • making your own decisions about care, services, and who to contact; and
  • using appropriate safeguards when communicating with third parties.

Do not rely on the Site as your only source for time-sensitive, medical, legal, or benefits decisions.

6) Strict No-PHI Rule (No Patient Medical Information)

Do not submit Protected Health Information (“PHI”) or patient-specific medical information through the Site.

You agree not to upload, post, message, transmit, or submit:

  • medical records, diagnoses, lab results, treatment details, prescriptions, or appointment notes tied to an identifiable person;
  • insurance member IDs, claim numbers, or benefit information tied to an identifiable person; or
  • any content that would be considered PHI or sensitive patient data.

If PHI is submitted, you authorize us to remove it. We do not intend to receive or store PHI through the Site.

7) Acceptable Use

You agree you will not:

  • access or use the Site if you are under 21;
  • use the Site for unlawful purposes;
  • misrepresent your identity or impersonate others;
  • harass, threaten, defame, discriminate, or post unlawful content;
  • disrupt the Site, introduce malware, or attempt unauthorized access;
  • scrape, harvest, or mass-collect data from the Site without written permission;
  • use the Site to send spam or deceptive solicitations; or
  • attempt to obtain PHI or patient-specific information through the Site.

We may restrict access to protect visitors, the Site, and our mission.

8) Privacy Policy, Cookie Notice, and Other Posted Policies

Your use of the Site is also subject to Mendry’s Privacy Policy and any posted Site policies (including directory criteria, listing standards, sponsor disclosures, and no-PHI notices). These are incorporated by reference.

If these Public Terms conflict with a posted policy, these Public Terms control unless the policy states otherwise.

9) Third-Party Listings, Links, and Sponsored Content

A) Listings may be incomplete or outdated

Directory and listing information may be incomplete, inaccurate, outdated, or changed without notice. You must verify information independently.

B) Third-party links and services

The Site may link to third-party websites or services. We do not control them and are not responsible for their content, policies, or practices. Use them at your own risk.

C) Sponsored content

Some content may be labeled “Sponsored,” “Paid Placement,” or “Podcast Sponsor.” Sponsored content is provided by third parties. Sponsorship does not imply endorsement by Mendry. Sponsors are responsible for the accuracy and legality of their content.

10) User Submissions (If You Submit Anything)

If you submit content through a form or other feature (for example, a message, comment, or upload), you represent that:

  • You have the right to submit it.
  • It is accurate to the best of your knowledge, and
  • It does not violate the law or third-party rights.

You grant Mendry a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your submission as reasonably necessary to operate the Site and further our nonprofit mission.

We may remove submissions at any time.

11) Intellectual Property

The Site and its content (including text, graphics, logos, design, compilation, and software) are owned by or licensed to Mendry and protected by law.

You may view and print pages for personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works, or exploit Site content without written permission except as allowed by law.

12) Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENDRY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENDRY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENDRY’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE PUBLIC TERMS WILL NOT EXCEED $100.

(Some jurisdictions do not allow certain limitations; in that case, these limitations apply to the maximum extent permitted.)

14) Governing Law and Venue

These Public Terms are governed by Florida law, without regard to conflict-of-law rules. To the extent any dispute is not subject to arbitration under separate Business/Member Terms (if applicable), you agree to exclusive venue in the state or federal courts located in Hillsborough County, Florida.

15) Changes to These Public Terms

We may update these Public Terms from time to time. Changes are effective when posted with a new “Last Updated” date. Continued use of the Site after changes constitutes acceptance.
